90 DAY STORECASH TERMS & CONDITIONS

These terms and conditions constitute a legally binding contract between The Good Guys and you in relation to 90 Day StoreCash, 90 Day StoreCash Offers, 90 Day StoreCash Review Opportunity and 90 Day StoreCash Competitions.

Please read the following terms and conditions carefully before participating in a 90 Day StoreCash Offer, 90 Day StoreCash Review, 90 Day StoreCash Competition, or otherwise earning, receiving or using 90 Day StoreCash. The terms and conditions contain important information about 90 Day StoreCash Offers, 90 Day StoreCash Review, 90 Day StoreCash Competitions, earning, receiving and using 90 Day StoreCash, and the Digital Wallet.

By completing the Sign Up Form or otherwise attempting to participate in a 90 Day StoreCash Offer, 90 Day StoreCash Review Opportunity, 90 Day StoreCash Competition and/or claim 90 Day StoreCash, you confirm that you have read, understood and agree to these terms and conditions.

1. Activating and accessing a Digital Wallet

(a) To be eligible to earn, win or receive and use 90 Day StoreCash, you must first complete the Sign Up Form and activate a Digital Wallet. The Sign Up Form requires you to provide your mobile phone number which The Good Guys will use to send you an SMS to activate your Digital Wallet and to send you verification codes when you access your Digital Wallet online. Please ensure that you enter all information on the Sign Up Form carefully. You warrant to The Good Guys that all information provided by you is complete, true and accurate. You may not complete the Sign Up Form on behalf of another person.

(b) When you have completed the Sign Up Form, The Good Guys will send you an SMS to the mobile phone number you have provided on the Sign Up Form requesting you to activate your Digital Wallet by clicking a link taking you to a webpage, where you must follow the prompts to either:

  1. download your Digital Wallet to your smart device; or
  2. activate your Digital Wallet online through The Good Guys website.

(c) If you choose to activate your Digital Wallet online through The Good Guys website:

  1. you can access it at https://www.thegoodguys.com.au/storecash; and
  2. you can also download your Digital Wallet to your smart device at any time by using the first SMS sent to you when you completed the Sign Up Form, or you can receive a new SMS from The Good Guys by filling out the Sign Up Form again at any time using the same information.

(d) If you choose to activate your Digital Wallet by downloading it to your smart device, you can also access your Digital Wallet online through The Good Guys website at https://www.thegoodguys.com.au/storecash at any time.

2. Downloading the Digital Wallet to your smart device

(a) A Downloaded Digital Wallet loads into Apple Wallet (iOS) or Google Wallet (Android) on your device.

(b) To be eligible to have a Downloaded Digital Wallet you must be aged 18+ and have a compatible smart device with a compatible operating system (iPhone 6 or later, running iOS 9 and above, or Android smartphone with NFC and Lollipop 5.0 or later).

(c) Additional terms and conditions relevant to Downloaded Digital Wallets and their operation may apply from your software provider, including the provider of your operating system such as Apple or Google, and/or your internet, handset or carrier provider.

(d) The Good Guys will attempt to send an update to your Downloaded Digital Wallet when you are entitled to receive 90 Day StoreCash rewards that you have earned or won. Whether such updates to your Downloaded Digital Wallet (including 90 Day StoreCash rewards) are actually received in your Digital Wallet will depend on your device’s operating system and its settings. In [particular/addition], you will not receive 90 Day StoreCash rewards in your Downloaded Digital Wallet if updates are not activated in the settings of your Downloaded Digital Wallet.

(e) To permanently remove a Downloaded Digital Wallet from your smart device, follow your smart device settings/manufacturer’s instructions.

(f) If your Downloaded Digital Wallet is no longer installed on your smart device, or is no longer functional or active on your smart device (for example, because you have not enabled updates from Apple or Google or another relevant operating system), you will not receive any further 90 Day StoreCash in your Downloaded Digital Wallet and you will lose access to any existing and unused 90 Day StoreCash in your Downloaded Digital Wallet. However, you will continue to be able to access any existing and unused 90 Day StoreCash in your Digital Wallet online through The Good Guys website at https://www.thegoodguys.com.au/storecash.

(g) Please note that removing a Downloaded Digital Wallet from your smart device will not unsubscribe you from The Good Guys marketing communications or Gold Service Extras Member Communications. To unsubscribe from marketing communications, you will need to follow the unsubscribe instructions in section 5(c) of these terms and conditions.

(h) By downloading a Downloaded Digital Wallet you acknowledge and agree that:

  1. you will ensure that your smart device is compatible with the Downloaded Digital Wallet, and is updated as required in order to remain compatible with, and allow optimum performance of, the Downloaded Digital Wallet at all times;
  2. you will keep your smart device secure and free from unauthorised access (including by installing and keeping up to date appropriate security software) and will keep confidential your mobile device’s lock, passcode, passwords, and any other information required for a person to access your Downloaded Digital Wallet and/or redeem any 90 Day StoreCash rewards stored in your Downloaded Digital Wallet;
  3. you will notify The Good Guys immediately if you believe that there has, or may be, unauthorised access to your Digital Wallet or your Downloaded Digital Wallet;
  4. if you wish to use 90 Day StoreCash stored in your Downloaded Digital Wallet in a The Good Guys store: (i) your device must have a charged battery; and (ii) the screen of your device must be able to be read easily (a cracked screen, dimming, dirt or any other fault, damage or obstruction, which prevents the Downloaded Digital Wallet from being clearly accessible may mean that any 90 Day StoreCash vouchers earned by you that are in your Downloaded Digital Wallet cannot be redeemed in store);
  5. peration of a Downloaded Digital Wallet is subject to a number of factors which are largely outside the control of The Good Guys and will be dependent on and affected by, amongst other things, your connection to the internet, your device and its settings, and the software and operating systems used on the device;
  6. you must take your own precautions to ensure that the process which you employ for accessing your Downloaded Digital Wallet does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your mobile device or its operating system, and contains appropriate protection to prevent damage to your mobile device and its operating system caused by viruses, malicious computer code or other forms of interference; and

3. How you can earn 90 Day StoreCash

(a) From time to time The Good Guys may make available to customers 90 Day StoreCash Offers, 90 Day StoreCash Review Opportunities or 90 Day StoreCash Competitions on its website, in store, or via various communications including email, SMS, catalogue, or social media. Gold Service Extras members are also entitled to receive 90 Day StoreCash in accordance with the terms and conditions of their Gold Service Extras membership.

(b) In order to be eligible to earn or win the relevant 90 Day StoreCash in relation to a 90 Day StoreCash Offer, 90 Day StoreCash Review Opportunity or a 90 Day StoreCash Competition, you must:

  1. satisfy all applicable Qualifying Conditions within the applicable Offer Period; and
  2. have completed the steps referred to in section 1(a) and (b) of these terms and conditions before [satisfying the applicable Qualifying Conditions].

(c) If you earn, win or are otherwise entitled to receive 90 Day StoreCash, your Digital Wallet will be credited once with the 90 Day StoreCash to which you are entitled.

(d) Any 90 Day StoreCash that you are entitled to receive:

  1. pursuant to a 90 Day StoreCash Offer will be credited to your Digital Wallet within a maximum of 7 Business Days after the collection/delivery of the Qualifying Product;
  2. pursuant to a 90 Day StoreCash Competition will be credited to your Digital Wallet within 7 Business Days of the draw/judging date of the 90 Day StoreCash Competition;
  3. pursuant to a 90 Day StoreCash Review Opportunity will be credited to your Digital Wallet within 7 Business Days of acceptance by The Good Guys of your review if it meets the relevant Qualifying Conditions; and
  4. under a Gold Service Extras membership will be credited to your Digital Wallet in accordance with the terms and conditions of your Gold Service Extras membership.

4. Communications

(a) By completing the Sign Up Form, you agree to:

  1. the collection, use and disclosure of your personal information as set out in The Good Guys Privacy Policy (as updated from time to time which can be accessed on The Good Guys’ website at www.thegoodguys.com.au/privacy-policy); and
  2. subscribe to marketing communications from The Good Guys, including in relation to 90 Day StoreCash Offers, 90 Day StoreCash Review Opportunities and 90 Day StoreCash Competitions. If you have a Gold Service Extras membership and have previously opted out of Gold Service Extras Member Communications then, by completing the Sign Up Form, you agree to receive Gold Service Extras Member Communications again.

(b) In order to receive 90 Day StoreCash Offers, 90 Day StoreCash Review Opportunities and 90 Day StoreCash Competitions via email and SMS, you must continue to be subscribed to receive marketing communications from The Good Guys or continue to be subscribed to Gold Service Extras Member Communications.

(c) In order to receive 90 Day StoreCash Notifications, you must continue to be subscribed to receive marketing communications from The Good Guys by SMS or continue to be subscribed to Gold Service Extras Member Communications by SMS.

(d) You can unsubscribe from marketing communications or Gold Service Extras Member Communications at any time, by:

  1. following the unsubscribe instructions in the relevant communication;
  2. via the Preference Centre on The Good Guys website, accessed through the Help Centre at https://www.thegoodguys.com.au/help-centre;.
  3. or via the unsubscribe link in the ‘Details’ section of the Digital Wallet downloaded to your smart device; or
  4. by sending an email request to privacy@thegoodguys.com.au.

However, please be aware that

  1. if you are not subscribed to either marketing communications from The Good Guys; or Gold Service Extras Membership Communications, you will not receive any further 90 Day StoreCash Offers, 90 Day StoreCash Reviews, 90 Day StoreCash Competitions; and
  2. 90 Day StoreCash Notifications are only sent via SMS. Accordingly, you must be subscribed to receive either marketing communications from The Good Guys or Gold Service Extras Membership Communications via SMS in order to receive 90 Day StoreCash Notifications.

5. 90 Day StoreCash Offers

(a) Individual product pages on The Good Guys website, and the 90 Day StoreCash hub at www.thegoodguys.com.au/storecash, show which Products are eligible to earn 90 Day StoreCash pursuant to 90 Day StoreCash Offers. 90 Day StoreCash is not earned on any Product unless a 90 Day StoreCash Offer is specifically advertised in relation to that Product.

(b) The following Products will never be part of a 90 Day StoreCash Offer.

Excluded Products Details
Agency Brand Products A Product where The Good Guys acts as an agent on behalf of the manufacturer/supplier. Agency Brands include, but are not limited to Miele, Asko, AEG, La Germania, Neff, Loewe and certain Smeg and Fisher Paykel cooking products. The Good Guys team members can provide a current list on request.
Purchases from websites other than www.thegoodguys.com.au Excluded websites include, but are not limited to, The Good Guys eBay store or via The Good Guys Commercial website or business.
Purchases of gift cards, digital or e-gift products Gift cards, digital vouchers, gaming credits.
Products purchased for commercial purchases Purchases for or in the name of trusts, companies and businesses, or which are otherwise for commercial purposes including (without limitation) commercial or residential developers, builders, subcontractors, installers and resellers.

(c) If you buy 3 or more units of the same Qualifying Product, you only earn 90 Day StoreCash on the first 3 units purchased.

(d) Where a 90 Day StoreCash Offer requires you to purchase a Qualifying Product then, in order for you to earn 90 Day StoreCash, payment for that Qualifying Product must be made by you in full, and the Qualifying Product collected by you or delivered to you, within 60 calendar days of order. If you arrange for delivery to take place within 60 calendar days of order but delivery does not take place through no fault of your own, you will still receive the relevant 90 Day StoreCash, provided that you have paid in full before the deadline.

(e) We suggest that you retain your original The Good Guys tax invoice(s) with your mobile number as proof of purchase of Qualifying Products. If we cannot link your purchase to your Digital Wallet (for example because you have given us an incorrect email address), then we may need to use the invoice for proof of purchase and, if you cannot provide it, you may lose 90 Day StoreCash that you would otherwise have earned.

6. Using 90 Day StoreCash

(a) 90 Day StoreCash may be used by you for purchases from The Good Guys in store, online (only at www.thegoodguys.com.au) or over the phone, and can only be used in a single transaction.

(b) All 90 Day StoreCash expires ninety (90) calendar days after the date on which it is credited to your Digital Wallet.

(c) Each 90 Day StoreCash reward will appear separately in your Digital Wallet rather than being totalled into a single balance. Each 90 Day StoreCash reward can only be used once and in one transaction although you can use multiple 90 Day StoreCash rewards in a single transaction. No change or credit will be given for any unused balance of an individual 90 Day StoreCash reward that is not used in full at the time of use.

(d) 90 Day StoreCash that you have received cannot be exchanged for cash and cannot be used for payment towards any Product that was purchased to earn the 90 Day Store Cash pursuant to the relevant 90 Day StoreCash Offer.

(e) The following Products cannot be purchased using 90 Day StoreCash:

Purchases from websites other than www.thegoodguys.com.au Excluded websites include, but are not limited to, The Good Guys eBay store or via The Good Guys Commercial website or business.
Purchases of gift cards, digital or e-gift products Gift cards, digital vouchers, gaming credits.
Products purchased for commercial purchases Purchases for or in the name of trusts, companies and businesses, or which are otherwise for commercial purposes including (without limitation) commercial or residential developers, builders, subcontractors, installers and resellers.

(f) 90 Day StoreCash is transferable and may be used by another person. To do this, provide the voucher number and PIN for the 90 Day StoreCash to the relevant person. If you believe that your 90 Day StoreCash has been stolen or subject to unauthorised access, please notify The Good Guys immediately.

7. How do you know if you have 90 Day StoreCash available to use?

(a) If you are subscribed to receive either: (i) marketing communications from The Good Guys via SMS; or (ii) Gold Service Extras Membership Communications via SMS, we will send you a 90 Day StoreCash Notification via SMS notifying you that 90 Day StoreCash has been deposited in your Digital Wallet and the expiry date. If you are not subscribed to marketing communications from The Good Guys via SMS or to Gold Service Extras Membership Communications via SMS, you will not receive 90 Day StoreCash Notifications and you are responsible for checking the status of your Digital Wallet to know when 90 Day StoreCash has been deposited. If you have a Downloaded Digital Wallet, then in order to receive updates to your Downloaded Digital Wallet (including any 90 Day StoreCash rewards that you are entitled to receive) you must allow updates to your Digital Wallet in the relevant settings of your smart device.

(b) To use 90 Day StoreCash when purchasing a Product:

8. Returning Products purchased using 90 Day StoreCash

If you return a Product that has been purchased by you using 90 Day StoreCash, The Good Guys will provide you with a The Good Guys Store Credit for a value equal to the value of the 90 Day StoreCash that was used to make the purchase, and any balance will be refunded to the other payment method used by you. Store Credits are subject to terms and conditions available at https://www.thegoodguys.com.au/store-credit.

9. Suspension and Termination of the Digital Wallet:

(a) The Good Guys may block, suspend or terminate your Digital Wallet if:

  1. The Good Guys reasonably suspects that fraud in relation to or connection with, or unauthorised access to, your Digital Wallet has occurred or may occur;
  2. you have, or The Good Guys reasonably suspects that you have, breached these terms and conditions;
  3. equired to by law;
  4. in the case of a Downloaded Digital Wallet, The Good Guys can no longer support the Downloaded Digital Wallet for any reason, including as a result of actions by the provider of an operating system such as Apple or Google, and/or an internet, handset or carrier provider; or
  5. The Good Guys chooses to withdraw the Digital Wallet for commercial reasons in its absolute discretion.

(b) Where The Good Guys takes any of the actions set out in 11(a)iii- v above it will provide you with reasonable notice in advance where practicable.

(c) The Good Guys may amend, update, change or remove the functionality of the Digital Wallet in its absolute discretion and without notice to you.

(d) Where The Good Guys terminates your Digital Wallet in the circumstances set out above it will, subject to your compliance with these terms and conditions, use reasonable efforts to provide you with another means of realising the value of any unexpired 90 Day StoreCash or other voucher in your Digital Wallet at the time of termination.

9. Liability

(a) Nothing contained in these terms and conditions shall be read or applied so as to exclude, restrict or modify, or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy or other obligation implied by any law (including without limitation the Australian Consumer Law) which cannot by law be excluded, restricted or modified.

(b) Except to the extent caused by The Good Guys’ negligence or breach of these terms and conditions, or as otherwise required by law, The Good Guys shall not be liable to you for any loss suffered by you to the extent caused by: (A) information that you have provided to The Good Guys in relation to the Sign Up Form, any 90 Day StoreCash Offer, 90 Day StoreCash Competition, 90 Day StoreCash Review Opportunity or any Gold Service Extras membership being incomplete or inaccurate; (B) any unauthorised use of, unauthorised access to, or theft of, your Digital Wallet, or 90 Day StoreCash which takes place before you notify The Good Guys; (C) any technical issues with websites, applications, operating systems, Digital Wallets, or the internet, beyond the reasonable control of The Good Guys; (D) any breach by you of these terms and conditions; or (E) anything outside of The Good Guys’ reasonable control and within your reasonable control.

(c) Except to the extent required by law or expressly set out in these terms and conditions, The Good Guys makes no representations or warranties of any kind as to the operation or availability of the Digital Wallet or the information, content or materials included in the Digital Wallet, and all implied representations or warranties in relation to the operation or availability of the Digital Wallet or the information, content or materials included on the Digital Wallet are excluded.

10. General

(a) The Good Guys reserves the right to amend these terms and conditions at any time. Any amendment will take effect from the time that it appears in your Digital Wallet or you are otherwise notified. The terms and conditions which apply at the time that you participate in a 90 Day StoreCash Offer, 90 Day StoreCash Review Opportunity or 90 Day StoreCash Competition are the terms and conditions which will apply to that 90 Day StoreCash Offer, 90 Day StoreCash Review Opportunity or 90 Day StoreCash Competition and any resulting 90 Day StoreCash.

(b) Any provision in these terms and conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise shall be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these terms and conditions or affecting the validity or enforceability of that provision in any other jurisdiction.

(c) These terms and conditions are governed by the laws of Victoria, Australia.

11. Definitions

90 Day StoreCash means a reward in the form of a voucher with a set value and expiry date deposited in your Digital Wallet that can be used to purchase goods and services at The Good Guys in store, online (only at www.thegoodguys.com.au), or over the phone.

90 Day StoreCash Competition means a competition run by The Good Guys that customers may enter for a chance to win 90 Day StoreCash subject to meeting the applicable Qualifying Conditions, and which is subject at all times to these terms and conditions and any other terms and conditions applicable to the 90 Day StoreCash Competition.

90 Day StoreCash Notification means an SMS sent to you by The Good Guys notifying you that 90 Day StoreCash has been deposited in your Digital Wallet.

90 Day StoreCash Offer means an offer from The Good Guys for customers to earn 90 Day StoreCash if the Qualifying Conditions are met, and which is subject at all times to these terms and conditions.

90 Day StoreCash Review Opportunity means an offer from The Good Guys for customers to earn 90 Day StoreCash by submitting a review of a product purchased from The Good Guys and meeting the relevant Qualifying Conditions.

Digital Wallet means the digital “wallet” made available by The Good Guys for you to access and use 90 Day StoreCash that you have earned, won or otherwise received, which is subject at all times to these Terms and Conditions.

Downloaded Digital Wallet means a Digital Wallet which has been downloaded to your Smart Device.

Gold Service Extras means The Good Guys Gold Service Extras membership program which is subject at all times to The Good Guys Gold Service terms and conditions available at https://www.thegoodguys.com.au/gold-service-extras-terms-and-conditions.

Gold Service Extras Member Communications means all communications (including marketing communications) sent to Gold Service Extras members relating to their Gold Service Extras memberships.

Offer Period means the period during which 90 Day StoreCash Review, 90 Day StoreCash Offer or a 90 Day StoreCash Competition is open for customer participation.

Product means a product available for purchase from The Good Guys, subject to the exclusions set out in these Terms and Conditions.

Qualifying Conditions means the conditions applicable to a 90 Day StoreCash Offer that must be met in order to earn 90 Day StoreCash, the conditions applicable to a 90 Day StoreCash Review Opportunity that must be met in order to earn 90 Day StoreCash, or the conditions applicable to a 90 Day StoreCash Competition that must be met for a chance to win 90 Day StoreCash.

Qualifying Product means a Product on which 90 Day StoreCash can be earned by purchasing that Product.

Sign Up Form means the online sign up form at https://www.thegoodguys.com.au/storecash/wallet-sign-up.

The Good Guys means The Good Guys Discount Warehouses (Australia) Pty Ltd (ACN 004 880 657).
